Toyota Crisis May Lead to Mandatory Brake Overriding Systems on All Cars

With increased focus on Toyota, lawmakers are placing pressure on federal transportation safety agencies to require that all automakers equip their vehicles with brake overriding systems. These systems would allow the brakes to override the accelerator pedal when both the brake pedal and the gas pedal are depressed at the same time.

Japanese Retailer in California Fined for Importing Defective Toys

California-based subsidiaries of Japanese retailer Daiso have been penalized $2 million by federal regulators for allegedly importing lead tainted toys into the country.

Daiso is based in California and Washington. Since 2008, Daiso California LLC and Daiso Seattle LLC have had to recall toys five separate times. A total of 690 toys and other children’s products were recalled after they were found to be contaminated with high quantities of lead. These toys included stuffed toys, wooden toys and purses. They were sold at Daiso stores in California for fewer than five dollars.

As the number of lawsuits over acceleration-related accidents involving Toyota vehicles increase, product liability attorneys involved in the litigation are looking at the cars’ black box recorders to offer clues that can help them understand the reasons for these crashes. The black box recorders are similar to those found on planes, and can help attorneys and accident reconstruction experts trace the steps leading up to a crash. As in an airplane crash, they can offer vital clues.

Ford Explorer Voucher Settlement Hasn’t Worked

In 2007, Ford Motor Company settled with consumers in California, Connecticut, Illinois and Texas to settle allegations that its Explorers were prone to rollover accidents. Under the $500 million settlement, consumers would receive a voucher of $500 that they could claim towards the purchase of the new Explorer, or a voucher of $300 towards purchase of any other Ford, Mercury or Lincoln model. That scheme, according to Law.com, has been a complete disaster with just about 75 owners out of one million consumers, choosing to redeem the vouchers as part of their settlement.

Mattel, Fisher Price Fined $2.3 million in Penalties for Lead Paint Violations

In what is the highest ever civil penalty for violating CPSC import and distribution regulations, toy maker Mattel and its subsidiary Fisher Price will pay $2.3 million in fines for importing toys containing excessive levels of lead from China and selling these in the country.

Army Doctor Falsified Medtronic Infuse Study on Injured Soldiers

An Army doctor, who was formerly at the Walter Reed Army Medical Center published a study that exaggerated the benefits of Medtronic’s Infuse bone growth product in treating severely injured soldiers. Dr. Timothy Kuklo, an Army investigation reveals, published the study that cited a far greater success in using Infuse for the treatment of injured soldiers at the facility than other doctors in the hospital. Dr. Kuklo is a paid consultant for Medtronic Inc., and the investigation has further fueled the already raging controversy over Medtronic’s promotion of unapproved use of its products.

Yamaha Rhino ATV Recalled, Sales Suspended

Yamaha Motor Corporation has announced a recall of its Rhino side-by-side All Terrain Vehicles (ATV), and has agreed to suspend sales of the vehicles that have been linked to several ATV rollover accidents.
