Two people were injured in a lumber truck accident south of Myers Flat in California

Two people were injured in a lumber truck accident after their car struck a load of lumber that rolled off a semi truck on Highway 101.  The accident occurred south of Myers Flat over the weekend. 45EEUPBVSKSV

According to the California Highway Patrol, a 67-year-old man was driving his 1994 Kenworth semi truck.  The truck was pulling a flatbed trailer that was completely loaded with lumber.  As the tractor-trailer negotiated a curve, the lumber fell off the truck, causing the 18-wheeler to flip over.  A motorist who was driving on the highway collided with the lumber, causing the car to overturn.  She and one of the passengers in her car sustained injuries in the accident.

The California Highway Patrol does not believe that alcohol or drugs were a factor in this accident.  The CHP is investigating the crash.

This crash is an appropriate example of the various kinds of ways that tractor-trailers can impact motorist safety.  A tractor-trailer does not have to be in direct contact with a passenger vehicle in order to cause severe injury.  In this case, the accident was caused because of lumber that spilled off the trailer, and collided with a passenger vehicle.  The motorist and a passenger in this case are very lucky that their injuries were not severe or life-threatening.

Motorists may be injured in an accident caused by cargo from a tractor-trailer that spills off onto a highway.  Sometimes, the cargo may drop right on top of a vehicle.  In such cases, motorists and passengers may be at severe risk of suffering an injury caused by the crushing impact of a falling load.  These accidents can be prevented if the cargo is probably secured on the trailer.

In any accident involving a tractor-trailer, there are several parties that a San Diego truck accident lawyer can name in a claim.  For instance, the trucking company that owns or operates the truck can be mentioned in a claim.  The truck driver can also be named in the claim, if the accident was caused due to shoddy driving.  Sometimes, accidents are caused due to the neglect of 3rd parties like truck maintenance or repair companies.  In such cases, these companies can also be named in a truck accident claim.  If the accident was caused by defective parts or components of the truck, then the manufacturer of those parts, or the manufacturer of the truck may be held liable for injuries or fatalities caused by the accident.

Determining who is accountable for your losses is a task that’s best left to a San Diego truck accident attorney.  Your attorney should be able to identify all parties that may be held liable for your losses and name them your claim.  When more parties are named in your claim, it can increase your chances of a fair settlement.
