Amusement Park rides can be dangerous if not maintained properly

Two persons including a child were injured in an amusement park accident at the county fair in San Diego this week.  The accident occurred on Tuesday, and involved a child and a midway worker.

The accident occurred at the annual exposition at Delmar.  One of the ride operators was apparently helping a little girl get off the ride when the ride unexpectedly began moving again.  Witnesses at the scene reported hearing a loud bang and then seeing the worker bleeding and injured.  The 12-year-old girl has suffered scrapes and bruises, while the worker suffered more serious injuries.

The accident occurred on the Techno-Power ride.  An investigation into the accident has already begun, and the ride has been shut down until inspections have been completed.  According to county officials, this was the first accident involving a ride at the fair in years.

People expect fun and thrills when they are on a ride.  What they don’t expect is that they will be seriously injured when they get on one.  Unfortunately, across the United States every year, dozens of people are seriously injured in accidents involving amusement parks, theme parks as well as smaller local fairs.

Most accidents involving amusement rides can be traced to the following factors.

  • Ride malfunction
  • Operator error
  • Lack of ride maintenance
  • Lack of safety restraints
  • Lack of maintenance of safety restraints
  • Defective design of the ride
  • Inadequate supervision
  • Lack of other safety equipment
  • Lack of safety precautions by riders
  • Loose cables
  • Failure safety equipment
  • Incorrect user instructions
  • Improper assembly
  • Electrical problems
  • Rusting and corrosion

Unfortunately, frequent maintenance of rides, and other precautions can be expensive for operators.  That’s the reason why Los Angeles amusement park accident attorneys often find that amusement parks, theme parks and other parties often compromise on safety.  Rides may not be inspected as regularly, and not be scheduled for maintenance as often as they need to be.  This can often have serious consequences for the people on a ride.

Filing a claim after an amusement park accident requires the expertise of a Los Angeles premises liability lawyer.  However, you may have a claim not just under premises liability laws, but also under product liability laws in case of an accident caused by a defective ride or a malfunctioning component.  There may be more than one party that can be named in your claim.  Damages that can be mentioned in your claim include medical expenses as well as future medical expenses that you may incur as a result of injury, pain and suffering, lost wages, and potential lost wages in the future.
