Reality TV Star Charged in San Diego Drunk Driving Accident

The list of celebrities charged with drunk driving continues to grow, California accident lawyers can now add the name of former MTV reality star, Puck Rainey. The star is expected to be charged with several drunk driving-related charges after an accident last week that seriously injured him and his eight-year-old son.

The accident occurred on route 79 near San Diego. Rainey was returning from a fishing trip with his son, when he suddenly swerved to avoid hitting an animal. He lost control of the vehicle, and the car went down an embankment. Rainey suffered several injuries, including a broken neck and multiple broken bones. He continues to remain hospitalized. His son also suffered several internal injuries, including a bruised liver. Rainey is facing charges of driving under the influence, child endangerment and driving without a valid license

Rainey’s accident comes as a new bill that will permanently revoke the driving privileges of repeat drunk driving offenders, makes its way through the California legislature. The bill has been sponsored by California Assemblyman Jerry Hill.  A.B. 1601 will allow California judges to consider a drunk driving offender’s entire history of DUI convictions over his entire lifetime, while deciding to permanently revoke his driving license. The law currently allows for judges to consider just 10 years of a person’s DUI history before deciding to revoke his license permanently.

Repeat drunk driving is a major problem in California. Assemblyman Hill says he was alerted to the seriousness of the issue when he came across a news report that profiled two drunk drivers who had managed to generate more than two dozen drunk driving convictions between them.

Not surprisingly, the DUI lawyers’ lobby in California is dead against any bill that would allow judges to consider a DUI offender’s entire lifetime of convictions before deciding to revoke his license. The fact is that we need stronger DUI laws in California. Our laws are some of the best in the country, but still have far too many loopholes through which intoxicated motorists can slip through and get back on the streets and behind a wheel. Repeat drunk drivers can be more dangerous because they are likely immune to the entire process of being caught, arrested or charged with drunk driving. There is no room for much fear, if you find that you’re likely to get away with a DUI offense with a light rap on the wrist. The bill would tighten the noose around such motorists, by threatening them with the loss of their driving privileges.

Critics moan that loss of driving privileges would deny these persons of an opportunity to go to work and school. Injury lawyers in California however would be far more concerned about the loss of rights and privileges that victims of drunk driving accidents suffer. The possibility of permanent loss of driving privileges could encourage motorists to think twice before they drive intoxicated.
