Santa Ana Man Killed in Freeway Car Accident

September 24th, 2010

Freeway Car Accident Due to Couch Debris
A couch that apparently fell off a truck or some other vehicle is being blamed for a fatal freeway car accident in Orange County that killed a Santa Ana man.  The accident occurred on Sunday when a Toyota Corolla struck a black couch lying on the southbound 5 freeway.  The Corolla collided with a GMC Safari, causing the van to roll over.  One of the passengers in the van was ejected from the vehicle, and sustained fatal injuries.  The van driver sustained minor injuries.

The California Highway Patrol has no reason to believe that alcohol or drugs played a role in this accident.  Meanwhile, authorities are looking for the owner of the couch.  It  likely fell off a pickup truck or other vehicle as it was being transported.

It’s fair to say this freeway car accident would not have taken place if the Corolla had not struck the piece of furniture lying in the middle of the freeway.  The accident occurred at 9:30 at night, and it is likely that the driver did not notice the dark colored couch on the road.  Investigators have a tough task ahead of them.  It’s going to be hard to locate the driver of a stray piece of furniture.  There is no information about whether there were witnesses at the scene.

A wrongful death is said to have occurred when a person is killed due to the negligence of reckless acts of another.  Fortunately, California’s laws provide for compensation for families who have lost loved ones, because of the carelessness of another.  A wrongful death action can be brought against persons who contributed to the death by their actions.  Typically, a wrongful death claim will seek damages for funeral and burial expenses, lost financial support, loss of household services and loss of consortium and companionship.  In rare cases, wrongful death claims may also result in punitive damages.

California wrongful death lawyers sometimes find that families of victims of fatal accidents hesitate before filing a claim.  It’s important however, to understand that the loss of a loved one, especially if he or she was the breadwinner or contributed financially to the family, is likely to lead to a major financial void in your life.  No amount of money can replace the value of a loved one, but recovering compensation for losses can help make your life after a loved one’s death, free of financial stresses.

Not every person involved in the deceased’s life may be able to file a wrongful death claim.  California wrongful death laws allow only certain members of the deceased’s family to file a claim.  This can include the victim’s spouse and children.  Besides, it can also include dependent stepchildren, and dependent parents.

A wrongful death claim may be filed in any case where a death occurred because of the negligence of another, including those resulting from automobile/truck/motorcycle accidents, slip and fall accidents, premises liability, and product and pharmaceutical liability.
