The NTSB is recommending a complete cell phone ban while driving

The National Transportation Safety Board is increasing its pressure on the federal administration and states around the country to come down even harder on the use of cell phones while driving.  The Board is recommending a complete cell phone ban while driving for all motorists.

The ban that the National Transportation Safety Board is recommending would include both hands-free as well as hand-held sets. It’s the first time that the Board has called for an all-encompassing ban like this that would completely prohibit the use of hand-held or hands-free cell phones for texting or having conversations while driving.  There will be exceptions made in the case of emergency calls.  The agency has several times reiterated its call for more restrictions on the use of cell phones while driving, but this is the first time that it has spoken of an all-out ban.  While the ban would include both hands-free and hand-held sets, it would not include any devices that are already installed in the car by manufacturer. The ban would include operators of all kinds of vehicles on the road.

This month, San Diego car accident lawyers have found the spotlight on distracted driving has been even more intense.  For the first time, the National Highway Traffic Safety Administration used a more accurate measure to calculate the number of people killed in accidents related to cell phone use while driving.  In 2010, according to data by the National Highway Traffic Safety Administration,, there were 3, 092 people killed in these accidents.

That number may be just the tip of the iceberg.  The agency believes that the numbers are likely much higher, because drivers do not always admit that they were distracted by electronic communication devices at the time of an accident.  Additionally, the National Highway Traffic Safety Administration released the results of another survey which found that at any given point in time, 13.5 million people in the country are using a hand-held cell phone while driving.

The National Transportation Safety Board’s recommendation is in response to an investigation that the Board conducted into a Missouri highway accident in 2010.  In that accident, a pickup truck driver who was texting on his cell phone caused a multi vehicle crash that left 2 people dead and more than 30 people injured.  According to the Board’s investigations, in the minutes before the accident, the pickup truck driver had received a total of 5 text messages on his cell phone, and has sent 6 messages.   Investigators also believe that the pickup driver was spotted leaning over just before the accident, indicating that he was distracted at the time.
