Orange County Man Killed in Boating Accident

June 6th, 2011
Orange County Boating Accident

Investigations begin looking the cause of this deadly boating accident0

A 46-year-old man, who was rescued after a boating accident off Strand Beach, has succumbed to his injuries in the hospital.   The Coast Guard responded to the scene of the accident after receiving a Mayday call from the boat.  When they reached the site, they found a man on a rock outcropping.  The man was arrested, and taken to the Laguna Beach Hospital, but he died later.

There were two other men and woman on the boat with him, and they had been washed ashore on the beach.  According to the Orange County Sheriff’s Department, the boating accident was likely caused by the weather.  At the time of the accident, the waves were estimated to be between nine and 10 feet high.

The year’s boating season is already here, and Orange County boating accident attorneys are concerned about the growing risk of boating accidents in the weeks and months ahead.  Boaters must understand that their accident risk increases because they’re now sharing the waters with other boaters.  Many of these boaters are likely to be inexperienced, reckless, and may be boating under the influence of alcohol or drugs.

This summer, make sure that you or the operator of the boat has completed a basic boat safety training course.  California has no mandated requirement that boat operators should have completed the course, but Orange County boat accident lawyers highly recommend this.  Even the Department of Boating and Waterways recommends that boat operators have completed the course that has been offered by the US Coast Guard auxiliary, or the American Red Cross.

Summer is also when drinking and sailing often mix.  According to the Department of Boating and Waterways, 24% of all fatal accidents in California can be traced to alcohol use.  California has strict laws prohibiting boating under the influence.  Boaters cannot operate a boat with a blood-alcohol level above.08%.  Operating a boat under the dangers of alcohol can be just as dangerous as driving under the influence alcohol.

California’s boating laws also prohibit boaters from behaving recklessly on the water.  Reckless boating behavior includes jumping into a wake when the other vessel is about 100 feet away from your boat, and making sharp turns into another boat in order to spray the occupants with water.  Such reckless behavior can be seen often during summer, and boaters must understand that the consequences can be deadly.  The operator of the boat must be sure that everyone on board is wearing life jackets.  The boat should be well maintained, and in proper operating condition.
