Parents of Los Angeles Apartment Fire Victim File Premises Liability Lawsuit

The parents of a man who suffered fatal burn injuries in an apartment fire, have filed a premises liability lawsuit against the landlord.

Mayqui Diaz lived on a ground floor apartment in the Pico Union neighborhood. In March 2008, a fire broke out in the apartment. Diaz tried to escape but was trapped because the security bars on his apartment had been wired shut illegally. Neighbors tried to pry open the bars, and help him escape. His roommate was able to make it out in time. Mayqui, however, suffered serious burn injuries. He was rushed to the hospital, and died the next day.

Woman Files Premises Liability Lawsuit in Marin Court

A woman who was struck by a motorist outside a deli has filed a lawsuit against the motorist, the deli, as well as the rental car company whose SUV the motorist was driving.

Investigators Probing Slip and Fall Accident Scam

Investigators in Wisconsin and Illinois are looking into a widespread slip and fall accident fraud involving at least 60 claims.

According to the Chicago Tribune, the scam was easy to operate. The fraudsters worked in groups, and while one person placed liquid or paper on the floor of a retail store, another person would step on it, slip and fall. A third person would act as a lookout to ensure that store employees remained unaware of the accident. They would then file a claim for a slip and fall accident resulting in an average payout of between $4,000 to 8,000. The scam involved 33 people who seem to have filed at least 60 fraudulent claims with 16 insurance companies that targeted big retailers in Illinois and Wisconsin between August of 2005 and February of this year.

Widow of Golfer Killed in San Diego Receives $2 Million Settlement

The Orange County Register is reporting that the widow of the golfer, who was killed after he drove his golf cart off an 80-foot cliff, has been awarded nearly $2 million in damages.

Woman Injured in Disneyland Tram Accident Settles

June 4th, 2009

A woman, who suffered serious head injuries during a tram accident at Disneyland, has reached a settlement with the Walt Disney Company.

In 2007, Qi Zhao was riding a tram outside Disneyland. As the tram entered a turnaround, Zhao’s sister fell off, causing a panic reaction by Zhao and another sister, who also fell out of the tram. While one sister suffered minor injuries, Zhao suffered a fractured skull when she hit her head on the pavement. She remained in a coma for three weeks. Later that year, she filed a lawsuit against entertainment giant Walt Disney Company, alleging that the tram was going too fast.

Stimulus Funds May Kick Start Clean up of Abandoned Mines

Efforts to get California’s numerous unsafe mines that are a potential accident and injury hazard cleaned up and closed, might get fresh impetus from the federal stimulus package. The package includes more than $1.5 billion for the Bureau of Land Management, the National Park Service and the Forest Service. The funds are expected to be used for eliminating the safety hazards posed by abandoned mines scattered across California, Arizona and Nevada.

SCWD Held Liable for Landslide Damage

South Coast Water District has been held liable for property damage caused by a landslide in 2005 that damaged four homes in Dana Point. According to the OC Register, SCWD is liable for the destruction of one house, and damage caused to three others when part of a hill began sliding in May of 2005.
