San Francisco City Offers to Settle Cable Car Accident Injury Lawsuit for $2 Million

Cable Car AccidentLawyers for the city of San Francisco have offered $2 million to a woman who was seriously injured in a cable car accident, to settle the accident injury lawsuit. According to the San Francisco Examiner, the settlement that has been proposed to the victim Alma del Bosque has not yet been approved by the San Francisco Municipal Transportation Agency.

The accident occurred on July 13, 2008, when the Powell Mason Line careened off the rails.   According to attorneys for Del Bosque, she suffered serious injuries including a fractured femur. The cable car hit a curb and del Bosque suffered injuries as a result of that.

On the day of the accident, the Powell Mason car became stuck at the Mason and Washington Street Intersection. Both the operators had to exit the vehicle to dislodge it. The conductors managed to free the trapped car, but one of the men fell as he attempted to board the car. The other was unable to apply the brakes to the car in time to stop because the front door was jammed. Neither operator was at the controls, and the car was racing up to a speed of 15 mph. It crashed into a street curb. Passengers inside the cable car were flung violently about. At least two other passengers who were also injured in the cable car accident have been offered $50,000 each.

According to the Transport Workers Union Local 250-A, it is very common for cable cars to become stuck at that particular intersection because of a design flaw in the tracks. According to a representative of the Transport Workers Union, MUNI was aware that such an incident had occurred before, and in these incidents, operators had to get down from the car in order to dislodge and push the vehicles.

This is not the first time that California injury lawyers have found the city’s cable cars involved in a situation like this. In December 2009, another passenger on the cable car was seriously injured when the cable car crashed into a double parked car. That passenger has already filed a lawsuit. In the <strong>accident injury lawsuit</strong>, he alleges that the operator of the cable car failed to stop or slow down before his car crashed into the stopped Honda. The passenger had his left foot severely crushed. The city offered $2.35 million to settle his lawsuit. However, he rejected that offer and instead chose to go before a jury. The trial will begin in June.

The San Francisco Municipal Transportation Agency is now finding that its fee collections don’t balance out the accident and injury settlement and payouts that it is being forced to make in these accidents.
